General Terms and Conditions
Article 1 – Definitions
In these terms, the following definitions apply:
Cooling-off period: The period within which the consumer may exercise the right of withdrawal.
Consumer: The natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.
Day: Calendar day.
Ongoing transaction: A distance contract relating to a series of products and/or services, for which the delivery and/or purchase obligation is spread over time.
Durable medium: Any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.
Right of withdrawal: The option for the consumer to withdraw from the distance contract within the cooling-off period.
Entrepreneur: The natural or legal person who offers products and/or services to consumers at a distance.
Distance contract: A contract concluded within the framework of an organized system for distance selling of products and/or services, whereby the contract is concluded exclusively through one or more techniques for distance communication.
Means of distance communication: A method that can be used to conclude a contract without the consumer and entrepreneur being physically present in the same place at the same time.
General Terms and Conditions: These General Terms and Conditions of the entrepreneur.
Article 2 – Right of Withdrawal
The consumer has the right to withdraw from the contract within a cooling-off period of 30 days without giving any reason. During this period, the consumer shall handle the product and its packaging with care.
If the consumer exercises the right of withdrawal, the product must be returned with all supplied accessories and, if reasonably possible, in its original condition, in accordance with the reasonable instructions of the entrepreneur.
Article 3 – Applicability
These General Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these General Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the contract is concluded that the terms can be inspected at the entrepreneur’s premises and will be sent free of charge upon request.
If the contract is concluded electronically, the terms may be provided electronically in such a way that they can be easily stored on a durable medium.
If, in addition to these General Terms and Conditions, specific product or service conditions apply, the consumer may always rely on the provision that is most favorable to them in the event of conflicting terms.
If one or more provisions of these terms are wholly or partially void or annulled, the remaining provisions shall remain in force, and the invalid provision shall be replaced by one that most closely reflects its original intent.
Situations not covered by these terms shall be assessed in accordance with the spirit of these terms.
Any ambiguities regarding interpretation shall also be interpreted in accordance with the spirit of these terms.
Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be clearly stated. The offer is non-binding, and the entrepreneur reserves the right to amend it.
The offer contains a complete and accurate description of the products and/or services.
Images are a true representation of the products, though colors may differ from actual colors.
Obvious errors or mistakes in the offer do not bind the entrepreneur.
All images and specifications are indicative and cannot give rise to compensation or cancellation.
The offer clearly states:
– Shipping costs
– How the agreement is concluded
– Whether the right of withdrawal applies
– Payment, delivery, and execution methods
– Acceptance period or price guarantee period
– Communication costs, if applicable
– Whether and how the agreement is archived
– How the consumer can review and correct provided data
– Available languages
– Applicable codes of conduct
– Minimum contract duration for ongoing transactions
– Optional: available sizes, colors, materials
Article 5 – The Agreement
The agreement is concluded at the moment the consumer accepts the offer and meets the conditions.
Electronic acceptance is confirmed electronically. Until confirmation, the consumer may cancel.
The entrepreneur takes appropriate security measures for electronic transactions.
The entrepreneur may verify the consumer’s ability to pay and may refuse or set conditions on an order if justified.
The consumer will receive, in writing or on a durable medium:
– The business address for complaints
– Conditions for exercising the right of withdrawal
– Warranty and after-sales service information
– Relevant data from Article 4
– Termination requirements for long-term or indefinite contracts
All agreements are subject to product availability.
Article 6 – Right of Withdrawal
The consumer may withdraw from the purchase within 30 days without reason.
The period starts the day after receipt of the product.
The consumer must handle the product and packaging with care and only unpack to assess it.
Returned products must be in original condition and packaging where reasonably possible.
The consumer must notify the entrepreneur in writing or by email within 30 days.
After notification, the product must be returned within 30 days, with proof of shipment.
Failure to comply makes the purchase final.
Article 7 – Costs in Case of Withdrawal
Return shipping costs are borne by the consumer.
Refunds will be made within 30 days after withdrawal, provided the product has been received or proof of return is provided.
Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal may be excluded for:
– Custom-made products
– Clearly personalized items
– Products that cannot be returned
– Perishable goods
– Products with price fluctuations beyond the entrepreneur’s control
– Newspapers and magazines
– Sealed media/software once opened
– Sealed hygiene products once opened
Article 9 – Price
Prices will not increase during the stated validity period, except due to VAT changes.
Market-dependent products may have variable prices.
Price increases within three months are only allowed by law.
After three months, increases are allowed if agreed and the consumer may cancel.
All prices are subject to printing and typographical errors.
Article 10 – Conformity and Warranty
Products and services must meet the agreement and legal standards.
Any guarantee does not affect statutory rights.
Defects must be reported within 30 days.
Warranty equals the manufacturer’s warranty period.
Warranty is void if products are misused, repaired by third parties, or damaged through negligence or non-compliance with instructions.
Article 11 – Delivery and Performance
Orders are executed within 30 days unless otherwise agreed.
Delays or partial delivery will be communicated, and the consumer may cancel.
Refunds will be issued within 30 days after cancellation.
If replacement items are delivered, this will be clearly stated and return costs are borne by the entrepreneur.
Risk passes to the consumer upon delivery.
Article 12 – Ongoing Transactions: Duration, Termination, Renewal
Indefinite contracts may be terminated at any time with up to one month’s notice.
Fixed-term contracts may be terminated at the end of the term with up to one month’s notice.
Contracts cannot be silently renewed for a fixed term, except certain periodicals under specific conditions.
After one year, contracts may be terminated with one month’s notice unless otherwise unreasonable.
Article 13 – Payment
Payments must be made within seven working days after the cooling-off period starts.
Incorrect payment details must be reported immediately.
In case of default, reasonable costs may be charged.
Article 14 – Complaints Procedure
Complaints must be submitted within seven days after discovery.
They will be answered within 14 days.
If unresolved, the dispute becomes subject to dispute resolution.
A justified complaint may result in replacement or repair.
Article 15 – Disputes
All agreements are governed exclusively by Dutch law, even if the consumer resides abroad.
